Multiple Zoning Amendments

Town of Cornwall, New York

In 1996, Garling Associates prepared several key zoning amendments designed to implement the Master Plan for the Town of Cornwall, an attractive town nestled in the Hudson Highlands.  The amendments included highly acclaimed cellular tower regulations, along with Conservation Subdivision Design provisions designed to protect visually sensitive areas of the town, and Ridgeline Protection zoning provisions to help protect important viewsheds.

 

Comprehensive Master Plan and Rezoning

Town of Deerpark, New York

Garling Associates prepared a new Master Plan and implementing zoning law and subdivision regulations for the Town of Deerpark, a rural town in western Orange County north of Port Jervis on the Delaware River. The 1988 plan concentrated on the creation of hamlet centers, where a variety of uses were allowed to develop controlled primarily by the Planning Board through the site plan approval process. Rural area development densities were based upon environmental constraints and the quality of roads. In order to increase density, developers were allowed to improve roads, cluster or otherwise overcome inherent constraints.

 

Master Plan and Zoning Revision

Town of Montgomery, New York

Our on-going work meets the current needs of this agricultural town with excellent highway access.  Recent zoning changes were designed to require landscaped setbacks along state highways to provide for future widening, and a “Gateway Overlay District” is in preparation to provide greater control over common drives, landscaping, architectural design, signage and setbacks to create an attractive and safe entry to the Town.  The rural and farm atmosphere of the area is preserved in a variety of ways through clustering, with open space provided for wetland preservation, woodlands, golf courses, farm parcels from ten to sixty acres, and general preservation of open areas along town and county collector roads.

 

Revision of Master Plan and Zoning Regulations

Town of Hamptonburgh, New York

Located in central Orange County, this rural farm community required an updated plan to address the change in economic life of the community, and to increase areas of large lot residential development. A plan was prepared and adopted in 1990 which addressed future service areas, airport zoning in accordance with FAA regulations, large lot development, and introduced planned development areas and transfer of development rights (TDR). Zoning regulations were prepared to effectuate the plan in 1994, though TDR was not included because the receiving areas were not yet developed. Scenic roads were identified in the Master Plan, and a scenic road overlay district and regulations were included in the zoning law.

Town of Mount Hope, New York

Mount Hope is a rural farm community in Orange County without major highway access, and is home to extensive farm and reservoir areas and views to and from the Shawangunk Ridge. This Plan, adopted in 1991, concentrated on upgrading three areas that were formerly resort or second home areas. Plans were prepared to direct Improvements in these areas, to relocate a portion of Long Path along the Shawangunk Ridge, and to designate scenic roads.  Protection for a reservoir system servicing the City of Middletown and preservation of an important gravel aquifer area were two important elements of this Plan. A zoning law prepared by Garling Associates was adopted by the Town Board to effectuate this Plan in 1997. Communication tower controls were included in the new zoning law.

Town of Neversink, New York

This rural Catskill town, located in a portion of the Catskill Park and home to two New York City reservoirs, had never had a Master Plan or Zoning Law prior to 1991. Garling Associates assisted with planning advice for a plan prepared by its Attorney, Town Clerk and Planning Board Chair, and a small but active committee. The first Zoning Law was soon adopted which allowed for development of various commercial and industrial uses, which tied more closely to performance standards and conditional or special use approval than to specific zones.

Master Plan Revision and Zoning Amendments

Town of Newburgh, New York

The Plan for Newburgh encompassed an area with Stewart Airport, an intersection of the Thruway and Route 1-84, and extensive water and sewer capacity. With the use of the City of Newburgh sewer plant, its own reservoir and a tap into New York City's Delaware Aqueduct, this community's plan for growth was tied to water and sewer services. Water and sewer capacities were determined, and then growth was planned based on environmental factors and the ability to provide services in 1991. A new zoning law to effectuate this plan was adopted in 1991.

Architectural Design District

Village of Goshen, New York

Working with a community restoration group, Goshen Restoration Unlimited, Garling Associates prepared the basis of an Architectural Design District local law in 1983-84 to amend the Zoning Law of the Village. The district encompassed the Church Park Historic District and the adjacent business area, and the regulations were adopted insuring that historic facades and textures were maintained.
